Legal Advice

Residential childcare is a highly regulated sector and such regulation is complex and regularly changing. All providers will most likely face challenges with regulation at some point in this complex sector, and while The CHA regularly supports members with such issues, specialist legal advice can also be necessary and vital in preventing unnecessary disruptions to your provision.

To help CHA members access specialist legal advice, we have appointed Stephensons as a trusted partner, who support our vision for exemplary residential childcare as an Official CHA Sponsor, and share their advice and expertise with our members.

Stephensons provide expert advice and representation to providers across the education and social care sector.

This spans compliance, inspections, enforcement action, criminal investigations and appeals to the first-tier tribunal.

Stephensons

"We have extensive experience representing registered health and adult social care providers and managers, on a nationwide basis, in relation to proceedings before the CQC. We support our clients with a full range of issues, from challenging inspection reports and registration refusals to helping them avoid enforcement action and criminal prosecution.

"Our specialist Ofsted and CQC lawyers understand the intense pressure on providers to comply with the vast, complex and ever-changing regulations governing regulated provisions, whilst ensuring that children are suitably protected and safeguarded. We appreciate how a negative inspection report, or any potential enforcement action, can significantly affect you, your staff and your business. We tailor our guidance to your unique circumstances and work closely with our commercial teams to enhance policies and procedures where necessary to assure the regulators of compliance without the need for serious action.

"Working with you, our expert team will help you to understand your legal position and where appropriate, navigate a path towards a successful resolution. Our team is highly regarded by both the Legal 500 and Chambers and Partners proving we are experts in our field. We also maintain established relationships with leading barristers and experts, so when you choose us as your solicitor you can be sure that you have the best possible support."
